morning. mother nature is seriously bringing us back to a reality check. a few high clouds. high pressure in control today. we are talking mainly sunshine. skies expected to be bright. and here's a look at our current temperatures. 35 at reagan national airport. 26 at dulles and bwi at 30. yesterday we were into the 50s. no such luck this morning. don't have to deal with the winds we had yesterday. so no windchills. into the course of today, here's a look at your planner. much cooler conditions expected. midday about 42 degrees. but bright skies and cold. we have changes coming up for the weekend, i'll have those details later. back to you. >> all right. on the roads right now, what we're finding is the accident activity still in the clearing stages.

tractor trailer overturn losing a load of pineapple on the highway. has to be off loaded. and they are off loading this pineapple from the truck which overturned. sky fox is live over the scene and what you are going to find is the beltway remains closed. as you make your way over to the exit to go northbound on 270 or continue at the dealt way, that's what all this activity is and slowing your role. northbound on 270 stay to the right. again, using the icc, randolph road or 410 to work your way around this. this is going to be with us throughout the remainder of our morning drive. 395 off to a slow start this morning as well. big back ups leaving the beltway up towards sure ling ton. that's a

check of your fox 5 on time traffic. >> at 2 minutes after the hour, we begin this morning with the latest on serious chemical weapons. unnamed u.s. officials. the serian army has loaded deadly gas into aerial bombs. >> and the army is waiting for orders from asad. serian forces have 60 days to use the chemical bombs before they expire and need to be destroyed. the united states has warned syria using them would cause greater eastern intervention. frj left five people dead and injured 600 others. the muslim brother hood which supports president morsi and protestors have demonstrated on different days and different

areas. they even fired shots at each other. this morning egyptian army tanks were deployed. the pro democracy protestors want morsi to cancel this month's vote. he's supposed to address the nation sometime today. >> the guess call cliff is less -- the fiscal cliff is less than a month away. >> house speaker john boehner and -- may be willing to take the plunge. doug luzader has more. >> the white house is drawing one line in the sand after another. republicans will give in as we approach the end of the year. >> we can solve this in about a week. it's not that tough. >> the president speaking to business leaders in washington. saying he is willing to make a deal. but his point man on

fiscal cliff negotiation struck a much different tone. if republicans don't but specifically tax rates on upper earners the white house is ready to go right over the cliff. >> we see there's no prospect to an agreement that doesn't involve those rates going up on the top 2%. >> largely backs the president on those rates. 48% support the plan to raise them on upper earners compared to 32% of leaving rates unchanged. when it comes to government spending, the gop has the edge. to help balance the budget, spending cuts should take precedence over tax hikes, 46 to 30%. and leaders in congress who met with business leaders say they have already offered to raise tax by cutting deductions and the president has yet to counter their proposal. >> i'll be here and available

at any moment to sit down with the president if he gets serious about solving this problem. >> it's possible the white house may be bluffing, the administration did order the pentagon to consider the big cuts in military spending that would happen if we don't reach an agreement. in washington, doug luzader, fox news. >> stocks closed mostly higher as wall street remains optimistic. but the economy will get a fresh update when the labor department released the november unemployment report. >> our big story here at home, police in fairfax county continue to investigate a disturbing find. >> a gun was found inside one of student's lockers. school officials ensure parents the kids were never at risk. melanie is live in fairfax county with the latest. >> reporter: good morning, tony and allison. students and staff

are starting to make their way in here to robinson secondary school a day after that disturbing find. the school says the community was never in danger, some parents are a little rattled about this. wish they knew more about what was going on. how many people were involved. they want to know what kind of gun it was and what was the reason it was brought to school. administrators say they were notified about the gun and they went and found it in the student's locker. they say there was an ammunition magazine in the weapon but no other details. and also didn't release the student's age, gender or grade level. could be a wide range there. a letter e-mailed to parents said they are quote taking the situation very seriously and appropriate disciplinary action will be taken. students and staff were never in danger but recognize

the danger associated with any weapon in the school they will continue to monitor the situation to ensure the safety of students. that is according to the principal, dan meier. the letter that was sent by the principal to the parents reto m. the suspects involved have been identified and questioned. we'd like to get more information and make that picture clearer here for parents and students. still waiting for more information from the school system and fairfax county police. >> all right. thank you very much. new this morning an update on the investigation in a possible campaign finance violations by vincent gray's 2010 campaign staff. the fbi is now looking into allegations

that gray's staff encouraged some supporters to donate. city law requires the disclosure of all campaign donations to the office of campaign finance. in the past the mayor has admitted his campaign had issues but denied any wrongdoing. also new this morning, a fight over a delegate seat is over. yesterday a judge said neither tiffany nor greg hall should serve. that means the governor is free to pick the vacant spot. austin previously held the seat. but she was officially ousted as a part of a plea deal. the democratic central committee picked hall to replace her. but the governor rejected because of hall 's past criminal record. >> the homeless than accused of pushing another man into the path of a new york subway train has been charged with second

degree murder. davis is being held without bail. pushed 58-year-old han into the subway tracks after an argument. the train hit and killed him. he has been in trouble with the law before. family members were holding funeral service for han today. software company founder john macafee. they took him into custody for allegedly -- in the fatal shooting of a neighbor. >> is the nation's capitol having an identity crisis? dc's nickname has been the chocolate city. but that's barely true in 2012. still ahead, a closer look at the new demographics taking over the nation's capitol. >> plus rgiii is canton bound.

have a name any more? we'll find out. >> i'm so glad to see her out of the hospital. >> good sign. >> i have read reports what that is alike. and not pleasant. >> and scary for her in her first pregnancy. we have a cool start this morning. a lot cooler than yesterday. we started out with temperatures in the 70s and then yesterday, temperatures in the 60s. 63 at reagan national. 54 at bwi marhsall . today temperatures in the 40s. a little closer to where we should be. we will be below the seasonal average. here's a look at your current temperatures. we have 35 at reagan national airport. 30 at baltimore. and 30 degrees to the south at fredericksburg. the temperatures on the cool side. 20s on there as well. and the winds however are staying light. that's a good sign. we had

gusty winds yesterday. clouds not a lot to speak about. a few high clouds to the north and west. we have a ridge of high pressure building in. that's going to set us up for sunshine during the course of the day. the winds will be calm. those gusty winds yesterday really were very brisk. but however, this is a big difference today. jet stream well to the north of us allowing cooler air to settle in. temperatures below seasonal and head into the day, we are going to end up seeing a day where we have 46 degrees for a high. sunny skies chilly with light winds. areas to the west over the mountains could see moisture sneaking in. maybe a little freezing rain there. >> any pretty snow? >> no. we're not talking the s word today. >> okay. thanks. >> let's get the latest on this morning's traffic. here's julie wright with that. >> grabbed my heart there for a second. >> she doesn't want to hear that.

the agency is expected to comment today on the drop in the number of metro riders. the washington examiner reports the lower than expected numbers have resulted in a loss of revenue of $5 million for the first quarter. translates to about a

2% drop. metro only estimated a 1% drop. a reduced federal transit benefit from employers. dc's demographics they are changing. >> that's right. the city is becoming younger, whiter and richer. according to the washington examiner, 34% are now white. that's up from 28% in 1999. the black population dropped from 60% to 51% over the same period. about 30% of residents are within the ages of 20 and 34 which is up from less than 27%. median household income has climbed 14% to $62,000 a year. the percentage of white residents has dropped. while asian, black and hispanic are on the rise. >> a precious sight is set to go

sons and the pop band fun. others include call me maybe which is up for song of the year. >> the music world is mourning the loss of jazz musician dave bruback. he was regarded as one of the greatest american jazz artists. he helped define the swinging smoky rhythms of the 1950s and 60s jazz scene. he was even designated a living legend by the u.s. library of congress. three years later he was the first modern jazz musician to be on the cover of time magazine. his hit you are hearing i believe take five became the first jazz record to sell a million copies and never gone out of print since 1959. he died of heart failure wednesday, one day shy of his 92nd birthday. >> the influences in jazz do not get much better than that.

cameras. we'll show you what else is out here. delays northbound on 395 leaving the beltway. and southbound oken he will worth avenue. that's a check of your fox 5 on time traffic. >> thank you very much. the fiscal cliff gets closer and closer. so what's it like to grapple with fiscal issues inside congress? both of our next guests served on the budget committee. joining us now is marty russo of illinois. he served on the house ways and means budget committees and robert walker of pennsylvania now executive chairman. good to have both of you gentleman here. we've hit this theme before. before i get into the details, i want to stress again, you guys, you come from opposing points of view. but you were able as were many

back in the day able to work together, find places where you could compromise. why does that seem to be so difficult now? >> well, in our days, it wasn't the majority of a majority. it wasn't like parliament system. we'd pick up republicans to pass. in those days bob michael was a heck of a minority leader. they would battle on the house floor. but in the end, it was what's in the best interest of the country. that's the same thing they did with president regan. it's what's in the best interest of the country ree. the ideas all about politics. who gets the upper hand. that's one reason why we can't solve these problems. when you look at congress, they put all these mechanisms in. we can't possibly want to do that. this would be horrible. >> i think you have to ignore

the fact too that this is not unusual. we went through the period of time until you get up to the point you can make a deal with all of this kind of haggling going on. the fact is there are only a handful of people in congress that are going to be a party to the deal. a lot of the rest of the people who are about this aren't part of the deal making. when the president and the speaker are talking as they did last night, that's a hopeful sign. whether or not they arrived at conclusions, nobody knows at the present time. the real deal making is taking place aside from a lot of the people who are making some statements. >> let's look at what the fiscal cliff really is. the fiscal cliff is almost $8 trillion of spending cuts, revenue increases. which if you want to affect the debt, that's a big way of doing it.

every economist says if you do that much that quickly, you are going to throw us back into a serious recession. you know what? at some point, we have to stop kicking the can down the road and actually thinking of long-term debt of this country. i'm never a big fan of senator cobern's positions but he's right. at some point we have to stop this. we need to do it quickly. >> and the fact is, we've got a huge spending problem. and so either you have to figure out a way to pay for what you say you want to do or reduce the spending and that's the piece that's not getting the attention it should right now. >> getting the attention from? >> either the media in some cases. they are talking about what we have to do on taxes. somewhere along the line we have to talk about what we have to do on spending. if you do as the

president asks and that is raise taxes on the top 2%, it funds the government for 8 days. you can't get there with just that. they are saying part of an overall deal. that's to include substantial spending cuts and particularly reforms and entitlements that is sure we can keep those programs alive in the years ahead. >> i want to ask both of you about tim gietner. is the white house ready to go over the fiscal cliff? and he said absolutely. is that digging in or a scare tactic? i was surprised to hear him say that. >> one of the biggest criticisms of president obama and the administration has been they tend to negotiate against themselves. i'm at this position and a week later i'm at this position. what he's trying to do is show their hardening their stance but in the end they

will make a deal. it's hard to raise $1.6 trillion in revenues. most of the deals we've seen that were working were two and a half to one spending cuts. and all you are hearing about is revenues. >> the republicans on the hill really believe that the president is prepared to go over the cliff and blame them. they believe this is a political exercise. and so they believe that's what's happening. gietner hardened their position. >> we have about a minute left. want to shift focus to syria. there's word that they are preparing chemical weapons i mean loading some of these chemical weapons into bombs and into planes. what are your concerns about this? there are the obvious concerns. but this puts the u.s. in a difficult position with how you deal with this if president asad goes forward with this. >> president obama has a huge problem on his hands right now

in this regard. we're dealing with a monster in syria. probably the only country that has any sway whatsoever is russia. seems to me president obama needs to be on the phone and make certain the russians are taking the right. >> apparently hillary clinton is talking. >> that's the only route that is going to stop this from happening. if left to his own devices, he will use those. >> and what about the countries that boarder. turkey. this stuff doesn't just stop. it gets into the atmosphere. you can't bomb the place. you have to send in ground troops. and now what happens ? the best thing that could happen is puten makes a phone call and says cut this stuff out. the middle east has gotten to be a very serious problem for everybody. >> maybe we will focus more on that next time around.

the safety of staff and students. still neither they nor police have publically said what led to the student bringing the weapon to school. administrators were the ones who found the gun. investigators say there was an ammunition magazine in the weapon but didn't lead details about what led officials to that locker or age, gender or grade level. this is middle and high school combined. could be a wide range there. a letter e-mailed to parents say they are quote taking this situation seriously and appropriate disciplinary action will be taken. also refers to more than one student involved saying quote the suspects have been identified and questioned. parents were notified using that e-mail alert system but doesn't sound like many students were told until they got home. they feel like

the dulles toll roads backed up lanes are open on 395 headed out towards the 14th street bridge. that's a check of your fox 5 on time traffic. >> thank you. a woman has been ordered by a judge to remove parts of online critiques she wrote on two consumer web sites. came after a local contractor sued the woman over the negative comments on yelp.com and angie's list. cases like this seem to be a growing trend. and joining us is attorney who specializes in defamation cases. good morning to you. >> good morning. >> 20 years ago you might not specialize in this because we didn't have to deal with things like this. but now it's a whole new world. i want to start with this case. are you surprised by the ruling? >> the ruling came out the judge required a small portion of the reviews to be removed.

i'm not terribly surprised. looks like certain portions were a little extreme to put it politely. but at the end of the day nothing has changed as to whether or not this particular reviewer will be liable. an injunction is an early portion of a lawsuit. it's an early win for the contractor, doesn't mean he's a guaranteed winner at the end of the day. >> the internet now, it's become this forum to share opinions, points of view or what have you. what rights does the consumer in this case have to post what they think is truthful? let's start with that. >> sure. one thing that's great about living in the united states is the first amendment, the right to free speech gives you a lot of protections. there are limits to those protections. the limits have been things such as your profession.

if you have sexual inuendo, those are the types of things that have gone too far. and to this day whether it was back 100 years ago or now on the internet, nothing has really changed on those issues. so those are the issues you need to stay away from. stick to opinions or facts. when it comes to things like theft, profession, diseases, steer clear. >> does the business have rights or the cost of doing business that someone might not be happy and post that or what have you? the forms are made for that. angie's list that basically is a clearinghouse for is this company okay and this one is not. and yelp too, the whole thing is reviews. >> one thing i have happened to

me almost everyday is businesses calling me up and saying i have a problem with a reviewer, what can i do? the harsh reality is these days you are going to have to fight in the open market of free speech. if someone gives you a negative review, you need to say listen, i respect that review but this is why i think what i did is correct. you need to use your own free speech to your advantage. defamation lawsuits are also an opportunity for you but you want to be careful about pursuing those unless the comments are relatively extreme. recently you've seen most judges in every court in the nation are less likely to take defamation cases seriously for minor issues because you have so many more outlets to get that free speech out there. twitter, the internet, blogs. >> we've had truth in travel agencies or what have you. their whole thing is this

company is basically misrepresenting itself. they have these pictures, this is not how this hotel really looks. so for the consumer, how much should we take and what should we throw out when we read some of these reviews? >> sure. the best thing to do as a consumer, just as it was 100 years ago, buyer be ware. be careful about what you seen. go to another web site. see if they agree. it sounds simple but that's something you should do. at the end of the day when you have a situation where something isn't necessarily the way that it was portrayed on a particular web site, the chances of recovering for those types of concerns, your hotel room wasn't nice. go through the entire process, it's simply not going to be worth it most of the time. >> laws changing to reflect our

so far i haven't found one man that says i do the shopping. let's talk about the germs. which is healthier for you guys. you are avoiding germs. we're talking about the cash. the problem with money and mom told us how dirty money is. the problem is it's porous. bacteria gets in there and it survives. let me tell you about the research. looked at about 300 people and did some swabbing and found that bacteria and we're talking about fecal bacteria founds on the hands of 11% of people, 8% of the cards and 6% of the bills. the problem is tony as we shop and during this season, we're handing this stuff back and forth and putting it in our purse and getting a snack and getting on the escalator. all these germs keep moving around. that's the big issue.

talk about the headline here. what is the message you are getting out? >> the holidays are a great time to observe and assess the situation with your family members. many times you haven't seen them. to grandmother's house to go. the holidays are a good time to see what's going on and maybe need more assistance or changes. >> as we mention, it can be so hard broaching this subject. you have proud folks who have done it themselves and now you are saying you might need a little help. but make sure we get to these different areas. you said going to grandma's house. if you get there and look around and doesn't look as neatly kept as it used to look, that might be a little hint that something is maybe a little not right. can you tell us more about what to look for? >> our home repairs being kept up. yard working done. things around the house that maybe are not good for safety.

is the lighting not as good? does a handrail need to be put in? the bathroom is a high risk area. maybe things that can help with safety. >> let's move on to driving. and this is another big one. you are dead on with this. 80 something year old, 90 something year old regardless of the age might not need to be driving any more. they have that valid driver's license. how do we know it might be time to take the keys away? >> the first thing to do is ride along with them. you want to observe. see are there dents and dings on the car. any dents and dings on the garage. are they having trouble at intersections? get some specific observations to share with them and then have a conversation and say i love you, i want to make sure that you are safe. how can we adjust this? maybe it's time to hang up the

keys. you have to have alternatives. >> let's move on to health. this one seems a little more obvious but maybe not really. are there small things we might miss? >> for one thing, nutrition is a big part of health. go in the fridge. is there food in the fridge? is there old food? look at medications. managing medications is a big thing. expired pill bottles around. maybe they need a pill organizer or a reminder system. are they keeping up with health issues in general? >> and this is the touchiest of them all. the finance issue. you're a great niece and don't want to appear to be nosing around to see if i'm going to get something at the end of life here. so i mean, we're just really making it plain here. how do you check on finances without appearing to be greedy or nosey?

>> the first thing to do is make sure when you arrive at the holidays, if there's a huge stack of mail that hasn't been opened, that's a clue maybe they are not keeping up with that paperwork. are there bills unpaid? are they not keeping up with that sort of thing. offering to help manage that stuff is a lot less intimidating than saying i want to know what's going on here. be very clear you just want to be supportive and help them remain as independent as possible. >> you touch on it with each one of these four bighead lines here. sounds to me like you need to have choices for the person. they still can make these decisions. is that the key here in these difficult subjects? >> exactly. you want to make sure you come in saying i love you, i want to support you. maybe changes are needed. how can i help you? here's some suggestions.

how do you go about getting people to be a part of the show? >> all of the performers are volunteers. they are not paid. the show is for all of america. and we extend invitation s where the performers are geographically. this year we had a wonderful response and actually, almost too many performers. >> that's a good problem to have. and also said something to come out here early in the morning to go through the rehearsal. any special requests from any of the stars and how they have to be taken care of? >> not so much how they have to be taken care of. they are all excited to perform for the first family. they are excited by being able to perform in front of the president. >> does the first family have any input? >> we always listen to the obama girls. >> very smart. if the obama

girls are happy, the parents are happy and we're all happy. this year it's the navy band and the different branches rotate. >> yes, they do. that's an essential feature . one of the military bands. and this year it is the navy band and they are terrific. wonderful compositions are playing. >> i want to know who gets these front row seats. >> well, first of all, the show is free and the tickets are distributed by a lottery. the 21,000 people are paying nothing to be here. got in through the ticket lottery. this is a show for washingtonians. and for those who didn't get into the lottery, they can watch the show at 4:30 tonight. >> for the people who do have the tickets, there's no specific seating? >> we have sections. so
